The difference affects who pays for repairs, what works can be carried out and how the floor area is valued. Review the title deed, the horizontal division and the owners' association bylaws.
2. Roof and waterproofing
The roof protects the penthouse and the rest of the building. Ask about the most recent waterproofing, any possible leaks into neighbouring properties and how maintenance costs are shared under the bylaws. 3. Pergolas, enclosures and swimming pools

When buying a resale penthouse, Property Transfer Tax (ITP) is payable. In Catalonia, the rate is 10% on value up to €600,000; above that, rates of 11% (from €600,000 to €900,000), 12% (from €900,000 to €1,500,000) and 13% on the portion exceeding €1,500,000 apply. If the buyer is legally classed as a large-scale property holder (gran tenedor), the rate is 20%.
